The Good, The Bad and The Ugly About Establishing A 501c3 Nonprofit

The good news is you don't have to struggle with the process of starting 501c3 nonprofits. You shouldn't have to. You are establishing a nonprofit to better this world, not to spend all your time completing stacks of paper work.

You are looking for answers and a solution to get your non-profit set up and running, and that's exactly what we do. Whether we can provide a few free answers to your questions, vital 501c3 advice, or take over the entire process of incorporation and establishing tax exempt status, we can make your life a little easier.

I am an attorney who specializes in starting 501c3 non-profit organizations and counseling ongoing operations. I mention this because it might be important to you when you make the decision to hire an experienced consultant and expert, rather than a form processing service, or someone who is not familiar with the process. We have a 100% success rate in establishing 501c3 non-profits with tax exempt status before the Internal Revenue Service. The success rate of nonprofit organizations attempting to do this on their own is far lower. “501c3 applications filed by lawyers are 10 times more likely to be approved than those filed by the organizations themselves” according to an IRS Agent, at the IRS Processing Center, Convington, KY.

Now, the bad and the ugly. Beware, you get what you pay for. "Incorporation" or "paralegal form processing" services leave you in legal limbo by only partially completing the startup process for you, or failing to get past the IRS review process. Some of these services don't even prepare the necessary documents for your incorporation, complete tax exempt status, and compliance with the law. We have helped countless nonprofit corporations out of this legal limbo, which I assure results in a much more costly, in time, money, effort, and lost opportunity. And these paralegal and incorporation services do not provide ongoing support in the years to come, as we do.

A Turnkey Solution to Receive Tax Deductible Contributions

We provide a straightforward, comprehensive turnkey solution to startup non-profits for a set fee. When you sign up for our 501c3 startup services, you can rest assured that you will have limited liability protection, responsible corporate governance, complete tax exempt status, and lawful compliance for your new nonprofit corporation.

The package includes securing your corporate name, incorporation, bylaws, minutes of your organizational board meeting, a conflict of interest policy, your Federal ID Number (EIN), documents necessary to open a bank account, and most importantly applications with the federal and state government for establishing your tax exempt status. You will be fully compliant for your first year, and you will receive a corporate records book, a free guidelines on maintaining your corporate and tax exempt status in the years to come. You Can't Legally Fundraise Until The Paper Work Is Done

You probably know that you cannot legally operate or receive grant funding as a 501c3 until you apply with IRS Form 1023. What you may not know is that unless you prepare these forms just the way the IRS wants, it can take well over a year or more to get tax exempt status on your own. If your 1023 application is rejected, you will have to fix the problems and submit your response, only to wait again for another review.

IRS 1023 or 1024 applications for establishing 501c3 tax exempt status are complex documents that require a lot of thought, information and time to complete properly. For example, new organizations must create and submit financial statements for the current year and proposed budgets for the next two years, including a detailed breakdown of revenue and expenses. There are also numerous questions on Form 1023, which if answered incorrectly, will result in further administrative inquiries and hurdles by the IRS.

I also know how you can receive funding for your non-profit, even though you can't legally fundraise as a 501c3 tax exempt organization until your tax exempt status is established before the IRS. This one bit of information alone can make the difference in getting started if you do not already have a big budget for operations.
